Abstract: In the context of copyright law, this article lays out some of the key differences between Berne Convention tenets and the ideals of a traditional cultural expressions (TCE)-based legal instrument. It outlines some current sui generis approaches and examines some problems in the semantics of the current international discussions on these issues.
