Abstract: same class of persons.But in the event of the bankruptcy of the trustee or other person liable, the cestui que trust can only prove in the bankruptcy along with the other creditors in respect of his personal claim.On the other hand, his right in the trust property itself as a res is a proprietary one which enjoys priority over creditors' personal claims.This illustrates the duality of rights which a beneficiary has in relation to trust property.
