The Law as a Mechanism for Social Change – The Case of the Doctrine of Informed Consent

Year: 2010
Type: preprint
The Doctrine of according to which a person should not be given medical treatment without the free and conscious consent, is one of the most important legal rules adopted in the twentieth century physician relationship. Though the adoption of this legal doctrine does not necessarily mark a change in prevailing medical practice or of doctors' opinions. How has this legal doctrine changed the prevailing medical practice and the physicians' opinions? This is the question in the center of this article. First, I will briefly explain the doctrine of informed consent and it's rationale. Then, I will examine the impact of the doctrine on the physicians and medical practice, and diagnose the causes of the limited role of law in the context of this doctrine. Finally, I will present the lessons of the future regarding the role of law as a means of social change in the context in question.
