Confessions of a Federal 'Bureaucrat': The Possibilities of Perfecting Procedural Reform
Year: 2016
Type: preprint
Abstract: We are told that the bloom is off the rose of federal procedural rulemaking; its Golden Age is over. Although the adoption of the Federal Rules of Civil Procedure accomplished a transformation of American civil procedure from the 1930s to the 1960s, for many the future of effective procedural rulemaking from the federal apparatus has become grim since the 1980s. Against this background, Professor Koppel has made the innovative suggestion that the states band together to pick up the cudgel of procedural reform from the faltering federal hands and bring it into the current century. This possibility is one theme unifying this conference.
