Speaking in Sentences
Year: 2011
Type: preprint
Abstract: Federal district judges today rarely preside over criminal trials. Instead, in the criminal law context, sentencing proceedings have become the main opportunities for the federal judiciary to interact with citizens — and vice versa. The process by which federal judges impose punishment at sentencing can rival the importance of the actual punishment. Notwithstanding Sentencing Guidelines, imposition of fair punishment requires the community’s arbiters to exercise individualized wisdom in a public ceremonial process involving many speakers and to use language that everyone understands.
