Abstract: а в а № 2 / 2 0 2 1 Бінарний підхід до трудових відносин: історичний розвиток та еволюція В даній статті проаналізовано еволюцію трудових відносин та питання історично-традиційного визначення правової природи відносин у сфері праці.Стаття також розкриває основні проблеми бінарного підходу до трудових відносин, що розрізнює підлегле працевлаштування та самозайнятість та не охоплює нові, нетипові форми трудових відносин, які стають все більш поширеними на сучасному ринку праці.Ключові слова: трудові відносини, трудовий договір, самозайнятість, підпорядкована праця, нетипові форми праці, бінарне розмежування в трудових відносинах This article analyses the evolution of employment relationships, provides a historical comparative overview of the formation of contractual arrangements that offered a backdrop to a traditional approach to labour relations, and highlights key issues surrounding the ongoing labour rights debates.The article also reveals the main issues surrounding the binary approach to employment relationships, which distinguishes between subordinate employment and self-employment and does not cover new, atypical forms of employment relationships given the changes in today's labour market landscape.
