Year: 2021
Type: dissertation
Abstract: The convergence between the internet and communication and information technologies culminated in the emergence of a new business modality structured on digital platforms, which launched a work format that differs from the previous ones since it works without any personal contact between the parties before, during or at the end of the relationship. The binomial flexibility-control, that characterizes this work, results in different legal interpretations concerning the best way to regulate such relations.Accordingly, the aim of this work is to identify the regulatory possibilities for granting legal and labor protection to workers on demand through digital platforms; what are the existing legal pillars for that and what rights would be included in this protection. To answer the proposed questions, a systematic approach was carried out, using the hypothetical deductive method for analyzing the material collected through indirect research technique, consistent with bibliographic and documentary sources. Thus, it aimed to contribute to the construction of an access route to legal and labor protection in order to ensure that services provider by digital platforms have a minimum set of rights, without which it is impossible to achieve the ideal of decent work for everyone and not just for employees.
