Abstract: This paper analyzes the existing debate in the United States about the limits and scope of freedom of speech, in light of the most important Supreme Court cases on that topic. Against the argument that hate speech is an opposite dimension to freedom of expression and should therefore be prohibited, it shows how the United States Supreme Court has historically defended the constitutionality of expressions that can be considered offensive, degrading, or vulgar. In order to differentiate hate speech from hate crimes, a historical analysis of the arguments of the Supreme Court justices is conducted.
