Managerial Prerogative and Collective Bargaining in the United States Supreme Court
Year: 2023
Type: article
Abstract: This article focuses on the role of managerial prerogative in collective bargaining. The law - which is ultimately in the hands of the courts - decides what issues unions can demand to bargain about and strike over. Managerial prerogative plays a very important role here and it is unitary; i.e., it concerns one law the ultimate meaning of which lies in the hands of one court: the U.S. Supreme Court.
