Abstract: الملخص: يهدف هذا البحث إلى بيان مدى حجية الاستحسان، والتعرف على التطبيقات الفقهية المعاصرة للاستحسان. وقد انتظم في مقدمة ومبحثين المبحث الأول: تعريف الاستحسان وحجيته وتناولت فيه: تعريف الاستحسان لغة واصطلاحا، وحجيته، والمبحث الثاني: تناولت فيه: أنواع الاستحسان وأثره في البيوع المعاصرة وتضمن: الاستحسان القياسي، والاستحسان النصي. وقد اعتمدت في هذا البحث على المنهج الاستقرائي؛ حيث قمت باستقراء المادة العلمية المتعلقة بموضوع دراستي من كتب الأصول والفقه. الكلمات المفتاحية:( الاستحسان، النص، الاستصناع، العرف، مقبول، مردود). Abstract: This research aims to demonstrate the authority of istihsan, and to identify the jurisprudential applications of istihsan. The first topic is organized in an introduction and two sections: the definition of approval and its validity, in which it deals with: Definition of approval, linguistically, idiomatically, and its authenticity, and the second topic: I dealt with: the types of approval and its impact on sales, and included: standard approval, and textual approval. The approach followed, in this research, is based on the inductive approach; Where I extrapolated the scientific material related to the subject of my study from the books of assets and jurisprudence. )Keywords: (Istihsan, te, custom, acceptable, return
