Year: 2024
Type: article
Abstract: The article examines the current issue of harmonization of national legislation with international standards in the field of prosecutor's office. The author analyzes various international documents that define the principles of organization and activity of the prosecutor's office, and evaluates the level of their implementation in Ukrainian law. Special attention is paid to the challenges faced by Ukraine in the process of reforming the prosecutor's office in accordance with international standards, as well as the prospects for further development. In our country, the process of reforming the prosecutor's office in accordance with the international standards of the prosecutor's office, which are defined by international legal acts and other documents, is ongoing. The author notes that quick reformation and adaptation of the activities of prosecutor's offices to international and European standards is impossible, and the legislator must take gradual, consistent steps in this direction. International standards of activities of prosecutor's offices are unified (standardized) rules on how individual states should regulate the organization and activities of prosecutor's offices at the national level. Based on the analysis of international documents, the author came to the conclusion that international acts are the foundation on which the reform of prosecutor's offices is based. The provisions of international normative acts correspond most closely to the level of development of modern democratic and legal states. And therefore, in the conditions of reforming the prosecutor's office of Ukraine, it is important to correctly implement the norms of these acts into the legislation of our states.
