Abstract: The Fédération Internationale de Football Association (FIFA) has set a service fee cap for football agents in its new FIFA Football Agent Regulations (FFAR). The respective regulations came into force on 1 October 2023. The article examines the question—in the negative—of whether this service fee cap is compatible with EU antitrust law. Following an overview of the relevant case law of various German state courts and the Court of Arbitration for Sport (CAS), the legal issues associated with the initial problem are analysed in detail.
