Type: article
Abstract: This article highlights the importance of amending Articles 248 and 250 of the Ecuadorian Civil Code regarding the contestation of paternity due to deception. It emphasizes the need to ensure a fair legal process that protects the child's right to know their true father and ensures justice for all parties involved. The objective of the research was to determine the legal consequence of contesting paternity through the nullification of voluntary recognition in the civil sphere on the grounds of deception. A mixed-methods approach was used, with a descriptive-explanatory-propositional scope and a non-experimental, cross-sectional research design. Empirical, theoretical, and statistical methods were employed for data processing. As a result, a proposal to amend Articles 248 and 250 of the Civil Code was formulated to facilitate the contestation of paternity through the nullification of voluntary recognition in the civil sphere on the grounds of deception. This proposal was subjected to expert review for validation, yielding optimal consistency, indicating its validity and feasibility for implementation.
