Certainty of Criminal Law of Brief Money to Recover State Losses
Year: 2024
Type: article
Abstract: The crime of replacement money is closely related to the crime of corruption as regulated in Article 2 and Article 3 of Law Number 31 of 1999 jo. Law Number 20 of 2001 states that there is an element of state financial loss. The benchmark for the success of recovering state losses is not only measured by the amount of replacement money decided by the court and how many assets were confiscated, confiscated or auctioned by the executing attorney but the most important thing is how much replacement money was deposited by the executing prosecutor. to the state treasury. This is a legal and factual benchmark for the recovery of state losses resulting from criminal acts of corruption from a long legal process, namely the stages of inquiry, investigation, prosecution and court trial to the verdict and execution of the decision by the executing prosecutor. The success of recovering state losses in Indonesia by using additional criminal compensation in the criminal justice system has not been able to recover state losses and therefore has not provided legal certainty.
