Abstract: The article characterizes the situation in the theory of Criminal Law in connection with the addition of the Criminal Code of the Russian Federation Article 2631, which provided for liability for violation of transport security. The debatable issues of the legal nature of the crime, its object, the legality of the recognition by the legislator of the act as a transport crime are analyzed, the ratio of the latter and the specified encroachment is revealed, in particular, the features of the content of the signs of their compositions are characterized, including the difference between transport security and transport security. The negative impact of disputes in criminal law theory on judicial practice is shown.
