Abstract: This article addresses the issue of the possibility of adopting surplus embryos as an alternative to determining their fate. This work aims to understand Brazilian legislation on cryopreserved embryos. Over the years, assisted human reproduction has undergone great advances, such as artificial insemination and in vitro fertilization. These advances have been the starting points for re-evaluating and updating the legal rules on the subject. With the increased effectiveness of the procedures carried out in clinics, the number of cryopreserved surplus embryos has also increased, which justifies the need for research and studies on this subject. To achieve our objective, we used the hypothetical-deductive methodology, which consisted of formulating viable hypotheses within the context, to answer the proposed problem. As a result, we found that the current legislation and resolutions of the Federal Council of Medicine allow the allocation of these embryos for research and even their donation, but with certain restrictions. This makes it possible and feasible to introduce the discussion of the topic of embryo adoption, which presents itself as an alternative for surplus embryos.
