Abstract: This paper considers a troubling form of apartheid ("constrained apartheid") on the basis of race, ethnicity or religion, and demonstrates that the major views claiming that subjection to the state's laws is a prima facie wrong or normative burden or cost ("subjection theories"), cannot easily challenge such an apartheid system. The analysis has several implications, which are briefly explored in the paper.
