Abstract: This paper aims to analyze the way in which Marx addressed the antinomies of the constitution and the question of democracy in the Critique of Hegel's philosophy of law, which are issues of paramount importance for constitutional law and political modernity. Moreover, the text contains a brief historical contextualization of the main philosophical, political and theological debates that took place in Prussia, especially in the 1830s. The research found, based on Michael Heinrich, that the traditional interpretation of the dissolution of hegelianism and the “young Hegelians” was a later historical-philosophical construction. In addition, it was demonstrated that Marx, in the Kreuznach Manuscripts, identified four antinomies of the constitution. Finally, it was explained that, in the Marxian conception, the resolution of such contradictions require the overcoming of the state and civil-bourgeois society, through a social revolution led by the proletariat.
