Can International Organizations Turn ‘Rogue’?
Year: 2024
Type: article
Abstract: Against the backdrop of Jean d’Aspremont’s “The Love for International Organization”, this short essay deals with international organizations straying from their assigned constitutional path after being instrumentalised by a few of their member states. The following challenges the rose-tinted notion of the distinct international legal personality of international organizations and their administrations’ functional independence by highlighting the phenomenon of (in)direct ‘institutional capture’. It is argued here that this sub-type of Member State-driven corruption is not uncommon within international organizations and escapes not only the general public’s eye but also international legal responsibility. Arguably, the best avoidance strategy lies in international organizations resilience-building coupled with the strengthening of internal control and remedy mechanisms.
