Abstract: This article examines the problematic issues that arise when establishing a public easement for a leased land plot. The establishment of a public easement may affect the tenant's ability to use the land for its intended purpose in accordance with the terms of the lease. The current legislation does not provide for special mechanisms to protect the rights of the tenant in such a situation. The authors analyze judicial practice in which the courts recognize the tenant's right to file a claim challenging the establishment of a public easement. An individual place in the study is occupied by the issues of payment for a public easement and notification of the establishment of such an easement.
