Abstract: تمارس المحكمة الدستورية دورها في الرقابة على دستورية القوانين في إطار الدستور، والقانون المنظم لعملها. وهناك موضوعات تخرج عن إطار رقابتها لدستورية القوانين. وهذا الأمر اصطلح على تسميته الاختصاص السلبي للمحكمة الدستورية، وعالج موضوع البحث هذا النطاق للاختصاص السلبي للمحكمة والذي تمثل في أعمال السيادة أو الأعمال السياسية، والأعمال البرلمانية، والنصوص الدستورية. وكذلك مسألة التعارض بين النصوص القانونية، وأخيرًا، عدم امتداد رقابة المحكمة الدستورية العليا إلى ملاءمة التشريع، أو بواعثه، أو ضرورته، وذلك في ضوء آراء الفقه، واتجاهات القضاء الدستوري المصري والمقارن. AbstractThe Constitutional Court practices its role in overseeing the constitutionality of laws within the framework of the Constitution and the law regulating its work. There are issues that are outside the framework of its oversight of the constitutionality of laws. This matter was termed the negative jurisdiction of the Constitutional Court, and the subject of the study dealt with this scope of the negative jurisdiction of the Court, which was represented in acts of sovereignty or political acts, parliamentary work, and constitutional texts.Also, the Supreme Constitutional Court's oversight does not extend to the appropriateness, motives, or necessity of legislation, in light of the opinions of jurisprudence and the trends of the Egyptian and comparative constitutional judiciary.
