Abstract: Freedom of opinion is one of the main foundations of a democratic country, where everyone has the right to express thoughts, views and criticism without fear. However, since the ratification of the new Criminal Code (KUHP), there has been a lot of debate in society. Several articles in the Criminal Code are considered to limit freedom of expression, especially regarding criticism of the government, state officials and certain institutions. This condition raises concerns that these regulations could have a negative impact on democracy and human rights in Indonesia. There are those who support this regulation on the grounds of maintaining public order, but many are also worried that civil liberties will be threatened. This article tries to review how the new Criminal Code affects freedom of expression in Indonesia, as well as looking at society's views and the importance of finding a balance between human rights and the public interest.
