Abstract: Legal protection for witnesses and victims has become more evident since Law Number 13 of 2006 concerning Protection of Witnesses and Victims (UUPSK 2006) was amended with the issuance of Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims (UUPSK 2014). Law Number 8 of 1981 concerning Criminal Procedure Law (UUHAP 1981) has been oriented towards protecting human rights, but is more related to the rights of suspects or defendants. The purpose of this descriptive analytical empirical normative research is to determine the extent to which the state's obligation to guarantee legal protection for witnesses and victims of criminal acts during the investigation stage is reviewed from the positive legal aspect in addition to the inhibiting factors. Therefore, protection for witnesses and victims needs to be prioritized so that the law is dignified and just because it reflects the benefits for both since the perpetrator became a suspect.
