Abstract: In order to apply in legal regulations of the transit of electricity the article examines the theoretical difficulties in definition of the concept of applicable law. The term is actively used in Russian legislation, while its content is not disclosed. The author concludes that the applicable law, in addition to the national law of a particular country, should be understood as the norms of international law, as well as the customs of international trade. At the same time, the article focuses on the need to distinguish the concept of a national legal system, which, in addition to the norms of national (local) legislation, includes the norms of international law and other recognized legal principles, from the concept of a system of national law, which means domestic legislation.
