Abstract: The author discusses the decision adopted by the European Commission (EC) on 10th July 2023, known as the EU-US Data Privacy Framework (DPF). The article evaluates the effectiveness of previous, historical EC decisions regarding the security of data tunnel flows by examining the assumptions of the Safe Harbour and Privacy Shield programmes. Additionally, the author discusses two famous proceedings brought by Maximilian Schrems, and conducts an analysis of the judgments of the Court of Justice of the European Union (CJEU) in these matters. The aim of these analyses is to assess the effectiveness and efficacy of the mechanisms introduced by the DPF, while pointing out the potential broader implications of these decisions.
