Abstract: The author’s doubts arise from the inclusion in the draft resolution of the temporal scope of the planned investigation with regard to the admissibility of examining the operational and exploratory activities undertaken by the prosecutor’s office. The draft only indicates the subject of the Sejm’s inquiry, without specifying the entities which are to be under the Committee’s control in this respect. The analysed draft may raise doubts as to its compliance with the constitutional requirement of sufficient specification of the case. In particular, the criterion of ‘abuse of the factual basis for the application of operational and exploratory activities’ is highly debatable.
