Features of Legal Relations in the Organization of Issuance and Circulation of Digital Financial Assets

Abstract: The article delves into the identification of specific features of legal relations arising in the field of the organiza-tion of the issuance and circulation of digital financial assets. It examines the content of the basic concepts un-derlying domestic legal regulation of social relations associated with digital financial assets as an innovative digital financial instrument. The public-legal nature of the legal relations emerging in the organization of issu-ance and circulation of digital financial assets is substantiated, with key subjects including operators of infor-mation systems responsible for the issuance of digital financial assets, operators engaged in the exchange of such assets, and the Bank of Russia, which is endowed with regulatory and supervisory powers over the activi-ties of these operators. The article describes the structural elements of these legal relations (the object, the main subjects, their subjective rights and legal obligations), as well as the legal facts that are the basis for their emergence and functioning.
