Abstract: In the article, the author presents an analysis of investigative and judicial practice on the classification of crimes against state power. The main attention is paid to such issues as: general and special elements of “official crimes”, establishing criminal consequences, as well as the motive for committing these acts. A critical understanding of law enforcement practice allowed the author to demonstrate typical qualification errors and develop proposals for its improvement. Key words: crimes against state power, significant violation of rights, other personal interest, competition of criminal law norms.
