Abstract: The article examines the legislative content of the patient’s right to replace the attending physician, as well as materials from judicial practice that make it possible to identify the most complex legal situations. A paired category is considered - the doctor’s ability to refuse to monitor the patient and treat him. Based on the materials of judicial practice, it is shown that the powers are not absolute. The main importance belongs to the principle of public health - the inadmissibility of refusal to provide medical care.
