Abstract: Фулей Т.І., к.ю. Report on the Rule of Law. The article considers the issue of non-unified use of the terminology for the translation of legal certainty in Ukrainian doctrine and practice. The author emphasizes that while some academics consistently support the term of "yurydychna vyznachenistʹ" as the only Ukrainian equivalent of "legal certainty", the vast majority of domestic scholars use different terms to indicate such a phenomenon: either in a way of using one term "pravova vyznachenistʹ" to express the authors' own point of view, while in references or especially in quotations simultaneously using terms as they appeared in those references, or in a way of using different terms as synonymous not only in different works, but also within the same publication. Also, terminological inconsistency, is characterized for the decisions of the Constitutional Court of Ukraine (CCU) and the Grand Chamber of the Supreme Court, and different terms are used to denote legal certainty.Noting that the source of such inconsistency is probably the variety of translational options of the term of legal certainty in the official/authentic translations of ECtHR judgements, the author notes that the use of different terms to denote the same notion is a fairly common phenomenon when it comes to "borrowed" and relatively new concepts, in particular, which are the elements of the "rule of law", and which, moreover, are understood differently by the Constitutional Court of Ukraine than in the Western legal tradition, and this difference is especially noticeable when compared with the ECtHR case law or the Venice Commission' Report on the Rule of Law.Considering that at the current stage, Ukraine is facing challenges related to the implementation of the Rome Statute of the International Criminal Court and bringing national legislation into line with European Union law (EU acquis), which will inevitably be associated with the mastery and assimilation of new concepts and terms that have developed in a foreign-language environment and do not have well-established Ukrainian equivalents, it is proposed to amend the national legislation and envisage, firstly, the unification of terminology as a requirement not only for regulatory legal acts, but also for judicial decisions and acts of the CCU, secondly, the possibility to provide editorial corrections to judicial decisions and acts of the CCU, and thirdly, the unification of existing translational options of "borrowed" terms.
