The article emphasizes the importance of alternative dispute resolution as an institution of out-of-court conflict resolution, which is a fairly popular method of protecting violated rights in most countries of the world. The author also analyzes the experience of foreign countries in implementing mediation as one of the alternative dispute resolution methods. It is stated that currently mediation as an alternative to litigation is quite common in foreign practice and is considered to be one of the most effective ways of dispute resolution and has a number of advantages over litigation. The author emphasizes the advantages of using mediation as a way to resolve a dispute, in particular, cost savings; time savings; confidentiality (meaning confidentiality of the procedure itself); and preservation of partnership relations between the parties. It is emphasized that this institution is quite new for Ukraine, but has recently become widespread. The article provides a historical overview of the legal origins of mediation in the countries of Anglo-Saxon law and the subsequent process of its spread on the European continent. The author analyzes the efforts of the UN, the EU, and other international organizations to introduce mediation procedures into national legal systems on the example of European and global legislation. The author also compares the role of such factors as voluntariness and compulsory nature (by court decision) in the implementation of mediation procedures and the spread of their use among the population. The author concludes that in order to promote mediation, it is necessary to raise public awareness of this type of alternative dispute resolution. It is also advisable to carefully study foreign experience regarding the introduction of mandatory mediation in certain categories of cases (e.g., family cases) and organizing multidisciplinary training courses for mediators. The author concludes that the introduction of mediation in Ukraine and its consolidation at the legislative level is a step in the right direction, since today it is one of the fast and relatively inexpensive ways to resolve disputes, which is conducted through negotiations and is applied exclusively by mutual agreement of the parties to the dispute.
