Abstract: The Italian legal system is distinguished by a unique way of ensuring the minimum wage and a special approach to determining its size. In the absence of a legal minimum wage and collective bargaining agreements with universal coverage, courts began to guarantee workers a minimum wage. To do this, they determine it in the amounts established as a minimum by collective agreements concluded in the employer’s field of activity, despite the fact that these agreements are not binding on him. However, this approach is not satisfactory. This study will justify the feasibility of legislative intervention in establishing the minimum wage and examines the draft rules on such regulation.
