Research on the Attribution of Rights to AI-Generated Content from an Intellectual Property Law Perspective

Year: 2025
Type: article
Abstract: This research examines the attribution of rights to AI-generated content from an intellectual property law perspective, systematically analyzing the fundamental differences between traditional copyright law and AI creation to evaluate the legitimacy of different rights holders. It aims to construct a rights attribution framework that balances the interests of all parties. The research shows that while AI works may possess formal originality, they lack the core elements of human intellectual creation, making it difficult for artificial intelligence itself to become a rights holder, while users who provide key creative input are most suitable to enjoy the primary rights. Based on this, the paper proposes rights attribution principles centered on users while also considering developers' interests, and suggests establishing differentiated rights allocation rules and registration systems, providing institutional ideas for the development of copyright law in the digital era.
