Abstract: In the digital age, the development of the digital economy has brought about a new technical upgrade in the form of infringement on consumers' right to fair trade. In contrast, the relevant laws for protecting consumers' right to fair trade appear conservative and lagging. The right to equality belongs to the category of basic human rights. As a high-level legal right,it requires timely follow-up by the law. From the perspective of "big data price discrimination", this paper analyzes the existing legal loopholes from the two dimensions of the Anti-Monopoly Law and the Consumer Rights and Interests Protection Law and the three links of the "price discrimination" process, and improves the relevant legal norms for the protection of the right to fair trade by clarifying legislation, extending the interpretation of the law, and using the law fairly, in order to provide a more real-time and effective legal reference for the protection of consumers' right to fair trade in the digital age.
