El juzgar desde la ciencia política

Year: 2025
Type: article
Abstract: Judging, when it comes to resolving conflicts over the distribution of resources and rights, is a political activity in essence. Given the existence of room for discretion in the decisions of the judge and potential biases in the decisions, it is to be expected that interested actors will try, through legal and illegal means, to influence the judge. In this article, I analyze this complex context for judges, focusing on the relationship between the judiciary and the executive branch. I discuss the implications for the strategic dilemmas faced by judges in public security issues that attempt to expand the limits of executive action, potentially affecting human rights in environments of high citizen demand for heavy-handed policies.
