Year: 2025
Type: article
Abstract: The article reveals the modern directions of modernization of the criminal policy key element — criminal legislation. The research is based on the doctrinal approaches to the definition of criminal policy that are traditional for criminal law science. The transformation of Russian criminal policy is directly related to ensuring the protection of key categories of national security — state, public, economic, information security, protection of traditional spiritual and moral values, culture and historical memory, and other national priorities. At the same time, the authors proceeded from the paradigm of the dynamic state of criminal policy: taking into account existing and projected risks and threats to national security, criminal policy should respond qualitatively to the changes taking place, primarily through the improvement of criminal law prohibitions. The purpose of the study is to prepare scientifically based theoretical provisions aimed at modernizing criminal policy primarily within the framework of the mechanism for improving criminal legislation in the implementation of national priorities. In the course of achieving this goal, the authors focused on a comparative analysis of current trends in the field of criminalization and alternative decriminalization of criminal law as areas of criminal policy in Russia and foreign countries. The methodological basis of the study was the dialectical method of cognition, general scientific methods of abstraction, analysis and synthesis, comparison and generalization, as well as special legal methods (comparative legal, logical legal, etc.). Conclusion. The development of conceptual theoretical foundations for ensuring national security will further transform the means of criminal legal influence, taking into account national priorities and the most dangerous threats and challenges to the state, society and the individual.
