Abstract: Theft offences have been be-coming one of the serious problems in Mon-golia for last two decades. Almost everybodyhas experienced to be theft victim. The mainpurpose of this study is to make analysis andconclusion on current state of sentencing fortheft. Information resource was collectedfrom National Police Agency, Research centerat Supreme Court, and Judicial research, in-formation, training institute at Judicial GeneralCouncil. Last five year statistics show that av-eragely 8900 theft incidents reported in a yearat police which is 1036 or 11.7 percent out of allcrimes adjudicated. As for sentence type andlength, 80 percent of defendants were im-posed imprisonment. It reveals that sentencepolicy has been very strict towards defendants.
