Abstract: Credit traffic jams in Indonesia are regulated through the Law on Guarantee Fiduciary , Civil Code , and Bankruptcy and Suspension Law Obligation Debt Payment . Settlement credit congested can done through execution right liability , which allows creditors auction asset debtor as effort return loans that are not paid . Research This use method study law normative with approach studies library and analysis regulation legislation , as well as based on theory certainty law . Research results show that use right liability , which includes mortgage and guarantee on object No move , give certainty law for creditors in finish credit jammed . However , the certainty law This is also greatly influenced by cooperation between debtors and creditors in signing agreement , which determines success execution right liability in a way fair and effective .
