Abstract: The significant growth of international trade relations between the Russian Federation and the China has led to an increase in the documentary transaction volumes, in particular, such as guarantees. The article provides a comparative analysis of security obligations in accordance with Chinese and Russian law. The author analyzes the regulations and judicial comments on the application of the rules on sureties and guarantees in China. The study revealed significant differences in the legal regulation of guarantees and sureties in Russian and Chinese law, as well as recommendations for structuring guarantee transactions involving Chinese counterparties.
