Abstract: This research entitled the material element of traffic crimes in the legislation in force in Palestine deals with identifying the legal framework regulating the material element in the traffic crime in its two forms represented by the positive act and the negative act, and studying the relationship between behavior and the result in achieving the legal framework controlling the crime, by standing on the exposure of the material element and the forms of its existence in traffic crimes in the legislation in force in Palestine, the positive act and the negative act and their forms in traffic crimes in the legislation in force in Palestine, and at the end of the research the researcher concluded that in all legislations the punishment for committing crimes is linked to the material element in its forms organized in the law, and at the end of the research the researcher concluded that any crime does not occur except with the availability of its tangible materials and the criminal behavior in traffic crimes has two forms, the first positive represented by doing the act and the second negative represented by not doing the act in the forms stated by law, and that the criminal result in traffic crimes is in two forms: the act of danger and the act of harm
