Uma análise da proposta do marco regulatório de Inteligência Artificial na União Europeia

Year: 2024

Abstract: Information and Communication Technologies are becoming increasingly complex and integrated into the daily lives of humanity, especially Artificial Intelligence (AI) due to its promise of facilitating people's routines. However, AI is a constantly evolving field, and defining its boundaries precisely can be challenging. The commercialization of personal data and the unknown form of corporate control over the use of AI-based mechanisms raise a cloud of questions about its nature and the paths to take for it to serve society's interests in a more predictable manner. Thus, this work has as theoretical landmarks the concept of artificial intelligence and the legislative process to which this term has been subjected, considering the growing use of artificial intelligence in various spaces and the contradiction surrounding its definition. To this end, a bibliographic review was conducted from a sociological-legal perspective in order to understand how the draft law for artificial intelligence in the European Union was constructed and how the definition of the AI concept presented by different stakeholders influenced the process, compromising the necessary understanding for the applicability and effectiveness of the legal object, since it is a "dependent variable of society and operates with the notions of efficiency, effectiveness, and efficacy of the law-society relationship."
