The validity judgment of the cross-border e-commerce platform’s choice of court provisions is the practical deepening and specific application of the goals of fairness, freedom and benefit value in the foreign-related agreement jurisdiction system. However, the pre-formulated selection of court jurisdiction clauses of cross-border e-commerce platforms are often invalid because they constitute B2C format clauses and the general agreement is beyond the scope of application, resulting in cross-border e-commerce platforms falling into effectiveness disputes, and the balance between litigation benefits and procedural fairness, as well as the balance between consumer protection and the legitimate demands of cross-border e-commerce platforms. In order to avoid unnecessary litigation, cross-border e-commerce platforms can fulfill full obligations and respect consumers’ right to express their will in the setting of pre-prepared terms, and supplement existing general terms with a negative list.
