Environmental analysis of the main provisions of the new procedure for monitoring lands and soils in Ukraine

Abstract: Розглянуто та проаналізовано екологічну складову Постанови Кабінету Міністрів України від 23 липня 2024 р. № 848 Про затвердження Порядку проведення моніторингу земель і ґрунтів.Дана Постанова враховує сьогоднішні реалії використання ґрунтів та земель в Україні, Директиви ЄС, що мають відношення до проведення моніторингу ґрунтів та земель.Моніторинг земель і ґрунтів, відповідно до нового Порядку здійснення моніторингу земель і ґрунтів, включає систематичні спостереження за станом земель і ґрунтів, виявлення у них змін, зокрема із використанням даних дистанційного зондування Землі, а також проведення оцінки: стану використання сільськогосподарських угідь; процесів, пов'язаних із змінами родючості ґрунтів, заростанням земельних ділянок, забрудненням земель пестицидами, важкими металами, радіонуклідами та іншими токсичними речовинами; стану берегових ліній водойм, гідротехнічних споруд; процесів, пов'язаних із утворенням ярів, зсувів, із сельовими потоками, землетрусами, карстовими, кріогенними та іншими явищами; стану земель населених пунктів, територій, зайнятих нафтогазовидобувними об'єктами, очисними спорудами, гноєсховищами, складами пально-мастильних матеріалів, добрив, стоянками автотранспорту, гірничими об'єктами, місцями захоронення відходів промисловості і радіоактивних відходів, а також іншими промисловими об'єктами; процесів, пов'язаних із забрудненням ґрунтів, засміченням земельних ділянок внаслідок надзвичайних ситуацій та/або збройної агресії і бойових дій під час воєнного стану.Визначено суб'єкти моніторингу та розподілено між ними функції.Моніторинг земель і ґрунтів проводиться такими суб'єктами: Державною службою України з питань геодезії, картографії та кадастру, Міністерством захисту довкілля та природних ресурсів, Міністерством аграрної політики та продовольства, Державною екологічною інспекцією, Державною службою з надзвичайних ситуацій, Державним агентством України з управління зоною відчуження, Державним агентством лісових ресурсів України, Державним агентством України з розвитку меліорації, рибного господарства та продовольчих програм.Ключові слова: ґрунт, земля, екологічний моніторинг, об'єкти, суб'єкти, функції, порядок. Tkachuk O., Mazur O.The environmental component of the Decree of the Cabinet of Ministers of Ukraine dated July 23, 2024 was considered and analyzed.No. 848 On approving the Procedure for Land and Soil Monitoring.This Resolution takes into account today's realities of soil and land use in Ukraine, EU Directives related to soil and land monitoring.Land and soil monitoring, in accordance with the new Procedure for Land and Soil Monitoring, includes systematic observations of the state of land and soil, detection of changes in them, in particular using remote sensing data, as well as assessment of: the state of agricultural land use; processes related to changes in soil fertility, overgrowth of land plots, land contamination by pesticides, heavy metals, radionuclides and other toxic substances; the state of the coastlines of water bodies, hydraulic structures; processes related to the formation of ravines, landslides, mudflows, earthquakes, karst, cryogenic and other phenomena; the condition of lands in settlements, territories occupied by oil and gas production facilities, treatment facilities, manure storage facilities, fuel and lubricants, fertilizers, vehicle parking lots, mining facilities, industrial waste and radioactive waste disposal sites, as well as other industrial facilities; processes related to soil contamination, land contamination as a result of emergencies and/or armed aggression and hostilities during martial law.Monitoring subjects have been identified and functions have been distributed among them.Land and soil monitoring is carried out by the following entities: the State Service of Ukraine for Geodesy, Cartography and Cadastre, the Ministry of Environmental Protection and Natural Resources, the Ministry of Agrarian Policy and Food, the State Environmental Inspectorate, the State Emergency Service, the State Agency of Ukraine for Exclusion Zone Management, the State Agency of Forest Resources of Ukraine, the State Agency of Ukraine for the Development of Land Reclamation, Fisheries and Food Programs.
