Securing the Territorial Limits of the Jurisdiction of Religious Organizations: Reality or Fiction

Abstract: The author’s intention is aimed at studying the problem of consolidating the territorial limits of the jurisdiction of religious organizations and making proposals for their extrapolation. There is a variety of approaches to determining the territory of the action of religious organizations at different stages of Russia’s history. The author indicates that at the moment religious organizations determine the territory of their action independently. This allows some of them to proclaim their jurisdiction at the all-Russian level, and sometimes on the territory of several states. The jurisdiction of Islamic religious organizations, including the Spiritual Administration of Muslims of the Russian Federation, the Russian Association of Islamic Consent, the Center for the Spiritual Administration of Muslims, as well as the Office of Muslims of the Caucasus (Azerbaijan), was chosen as the object of research. The author pays great attention to the phenomenological analysis of the constituent documents of these religious organizations, their relationship with each other. Conflicts are revealed – disagreements or contradictions between individual provisions of the charters of different religious organizations. Such areas of activity of religious organizations as the management of the activities of Muslim organizations, the opening of Islamic educational institutions, the organization of hajj (pilgrimage to Mecca), the production and distribution of Islamic literature, the development of spiritual and cultural ties with Muslims abroad are considered. The analysis showed that most of the provisions on the extension of the jurisdiction of religious organizations throughout Russia or the North Caucasus are fiction. The author’s position on the need to improve the constituent documents of religious organizations and eliminate the corresponding conflicts from these documents is proposed. The conclusions formulated in the study and proposals can be used in the development and improvement of the constituent documents of spiritual organizations.
