Type: article
Abstract: In modern conditions of complex international relations and the search for the optimal way to develop the state’s economy, cost reduction in legal regulation is seen as one of the most important tasks facing the legislator and law enforcement officer. It is necessary to conduct scientific research with recommendations on improving law-making, the content of legal norms and optimizing law enforcement procedures in practice. The article is devoted to the study of the development of the idea of procedural economy from the standpoint of various branch sciences, the study of the content of this principle, its normative legal fixation, the general patterns of its implementation, as well as the influence and role of the principle on the cost of law enforcement. The author comes to the conclusion that the principle of procedural economy is a principle inherent in civil, criminal proceedings, as well as arbitration and administrative proceedings and constitutes one of the fundamental guiding ideas in the application of law, which gives reason to define the principle as intersectoral. It is noted that the general legal features of this principle include: the unity of the development of the idea of procedural economy in various industries; the absence of formal consolidation of this principle in normative legal acts, but its recognition as such in practice and in doctrine; orientation to the principle as a fundamental idea in lawmaking and law enforcement, aimed at speeding up, simplifying or reducing the cost procedural procedures; expression of the general trend of the state’s legal policy aimed at saving money. The principle of procedural economy is understood by the author as a guiding principle that ensures the most rational use of funds in order to quickly and correctly resolve legal cases with minimal effort, money, and time of all participants in procedural relations.
