Year: 2024
Type: article
Abstract: The author stresses the necessity of updating such a criminal procedure sub-insttute as interagency cooperation during preliminary investigation. The author states that the balance between ensuring high-quality investigation of the gravest crimes and carrying out necessary investigative actions promptly could be achieved through the work of interagency investigative groups. At the same time, the author stresses that in modern conditions the question of establishing interagency investigative groups is highly relevant due to various reasons, conditions and circumstances. In view of terrorist attacks carried out on the territory of the Russian Federation in 2022–2023 and the existing threat of new attacks, it is necessary to ensure a speedy and high-quality investigation of such crimes based on interagency cooperation of subjects of criminal procedure and operative search work. Research results show that an effective mechanism of cooperative investigation should combine procedural means and operative search possibilities (operative support of crime investigation), thus, it is necessary to duly optimize such a combination in law enforcement work connected with the preliminary investigation conducted by an interagency investigation team. Besides, the author draws attention to the problem of overcoming “dual subordination” in the work of an interagency investigation team. Thus, in order to avoid dual subordination, it is necessary to provide for a corresponding mechanism of organizing the work of such a team: for the period of deployment in the team, its members should report solely to the head of this interagency investigation team.
