Awareness of Mandatory Reporting of Intimate-Partner Violence: A Thematic Analysis of the Perspectives of Help-Seeking Victims and Perpetrators and Service Providers in Norway

Type: article
Abstract: Purpose To explore the awareness of mandatory reporting of intimate-partner violence (MR-IPV) among help-seeking IPV victims and perpetrators and service providers in Norway. Methods A qualitative study of IPV service providers (N = 59) and help-seeking IPV victims and perpetrators (IPV victims, N = 10; IPV perpetrators, N = 8) was conducted. Data was collected through semi-structured, open-ended interviews. The analysis was informed by Braun and Clarke’s seven-phase thematic analysis. Results Despite extensive contact with service providers, most help-seeking IPV victims and perpetrators seemed unaware of MR-IPV. These individuals tended to withhold information about IPV from service providers, due to the fear of the consequences of reporting. This may negatively impact service providers’ ability to fulfill their duties concerning MR-IPV. The majority of service providers perceived MR-IPV solely as a professional duty, and they were unaware that it was an individual duty requiring them to address or prevent IPV after disclosure. This reasoning led to the transfer of responsibility to others. Finally, service providers seemed more familiar with their professional guidelines than with MR-IPV. Conclusion The Norwegian Penal Code includes MR-IPV as one of the tools to prevent IPV. However, awareness of MR-IPV among help-seeking IPV victims and perpetrators, as well as service providers, is mixed. Also, there are inconsistencies regarding professional laws and guidelines, structural and individual responsibility, and thresholds for MR-IPV. Based on this study’s findings, we recommend increasing knowledge about MR-IPV among service providers and the general population. The wording of Section 196 of the Penal Code should also be changed.
