Individual Security and the Constitutional Right to Public Information and the Protection of Personal
Year: 2025
Type: article
Abstract: The development of the information society forces the state to redefine its approach to individual security. Modern threats, such as cyberattacks, data theft or the impact of disinformation on decision-making processes, emphasize the need to protect information in all forms – from its acquisition, through processing and storage, to sharing. In a democratic state of law, such as the Republic of Poland, the right to public information and the protection of personal data guaranteed in the Constitution of the Republic of Poland of April 2, 1997 constitute one of the pillars of citizens’ security, requiring at the same time continuous improvement of society’s digital competences. The aim is to find conclusions de lege lata and demands for a balance between the constitutional right to public information and the protection of personal data and privacy of an individual in the state, which is the subject of considerations in this article.
