ويوصي الباحث المشرع المصري والمنظم السعودي ان يعتمد صور بطلان حكم التحكيم بسب تقرير الخبير، مقترحا النص الآتي: " 1ـ تقبل دعوى بطلان التحكيم القائم على تقرير الخبير في الأحوال الآتية: أـ إذا أخل الخبير في تقريره بمبدأ المساواة بين الخصوم ب ـ إذا أخل الخبير بالإجراءات الجوهرية التي نصت عليها قواعد الإثبات وقواعد المرافعات المدنية والتجارية واللائحة التنفيذية للمحاكم التجارية ج ـ إذا تجاوز الخبير في تقريره نطاق اتفاق التحكيم وفقا لما ورد في قواعد سلطة هيئة التحكيم د ـ إذا وجد في التقرير مخالفة لقواعد النظام العام او أحكام الشريعة الإسلامية 2ـ وتقضي المحكمة التي تنظر دعوى البطلان من تلقاء نفسها ببطلان حكم التحكيم دون النظر في الوقائع التي قام عليها تقرير الخبير " This research deals with the statement of the specificity of expertise before arbitration bodies in Egyptian legislation as well as in the Saudi system, and the general cases of invalidity of the arbitration award stipulated, and the special case of invalidity of the arbitration award due to the expert report, which is not considered a method of appeal known in the ordinary judiciary, but is a means of reviewing defective arbitration awards without giving the Court of Appeal the right to address the subject of the dispute, as invalidity of the arbitration award due to the expert report is an indirect reason for invalidity, following the comparative analytical and applied inductive approach. The special reasons for invalidating the arbitration award for the expert report are realized if the report is defective or violates the principle of equality between the parties or violates the essential procedures that must be followed when writing his report, or if the expertise exceeds the scope of the arbitration agreement, or the report violates public order or the provisions of Islamic law. The researcher recommends that the Egyptian legislator and the Saudi regulator adopt the forms of invalidating the arbitration award due to the expert report, proposing the following text: " 1- The arbitration invalidity claim based on the expert report is accepted in the following cases: A- If the expert violates the principle of equality between the parties in his report B- If the expert violates the essential procedures stipulated by the rules of evidence and the rules of civil and commercial litigation and the executive regulations of commercial courts C- If the expert exceeds the scope of the arbitration agreement in his report in accordance with what is stated in the rules of the authority of the arbitration panel D- If the report is found to violate the rules of public order or the provisions of Islamic law 2- The court that considers the invalidity claim shall rule on its own initiative to invalidate the arbitration award without considering the facts on which the expert report was based."
