Abstract: 监察法规作为一种新的法规范形式，促进了我国法律体系的发展。为了使监察法规能够更好地融入我国的法律规范体系，有必要进一步厘清监察法规与宪法、法律、各类法规以及司法解释等法律规范的关系。经过分析发现，监察法规的位阶与行政法规一致，这可以确保监察机关能够独立行使职权，不受行政机关的影响。同时，为了构建集中统一、权威高效的监察体制，地方性法规在未获得明确的授权前，不得对监察法规制定变通性规定。As a new form of legal norms, supervision regulations have contributed to the development of China’s legal system. In order to better integrate the supervision regulations into China’s legal normative system, it is necessary to further clarify the relationship between the supervision regulations and the Constitution, laws, various regulations and judicial interpretations and other legal norms. After analysing the supervision regulations, it is found that the rank of the supervision regulations is the same as the administrative regulations, which can ensure that the supervisory organs can exercise their powers independently, without the influence of the administrative organs. At the same time, in order to build a centralised, unified, authoritative and efficient supervisory system, local laws and regulations are not allowed to make alternative provisions to the supervisory regulations without first obtaining explicit authorisation.
